Three Arrested for Battery in the First Degree


On 11/03/15, Flippin Police Department responded to an assault with a firearm on Winchester St. in Flippin. Upon arrival contact was made with Brittney Cunningham (26 y/o). Ryan Eberly (22 y/o) had fled the scene prior to law enforcement arrival. The victim, Billy Newman (31 y/o) had also left the scene and was located at another location. Newman was interviewed by another Flippin Officer. It was determined by several witnesses that Newman had gone to the residence on Winchester St., and upon entering the residence was attacked by Cunningham and Eberly. Newman was struck in the head with a .22 cal revolver and Eberly and Cunningham made death threats against Newman. Newman received non-life threating head injuries. A third assailant was identified, Kendrick Sebree, (20 y/o) and arrested at scene for warrant from other county. On 12/11/15, Sebree was charged by Flippin Police Department for 1st. Degree Battery while he was in the Marion County Jail from previous warrant. On 11-04-15, Eberly was arrested in reference to the assault and an outstanding warrant from Baxter County Sheriff Office. Eberly was charged with the assault and recently transferred from Baxter to Marion County Jail. Cunningham was arrested at scene of incident and placed in the Marion county Jail. A search warrant was obtained for the residence on Winchester St. and the weapon used in the assault was located as well as syringes, methamphetamine, methamphetamine smoking devices, marijuana smoking devices, and digital scales. Eberly is currently in the Marion County Jail with his bond set at 75,000 for 1ST. Degree Battery. Kendrick Sebree was arrested on 11/03/2015 and is currently in the Marion County Jail for 1st. Degree Battery, bond set at $50,000. Brittany Cunningham was arrested on 11/03/15 for 1st. Degree Battery, possession of defaced firearm, possession of controlled substance, possession of drug paraphernalia; bond was set at $25,000. Cunningham bonded out of the Marion County Jail on Nov. 20th, 2015. Battery in the First Degree is a Class B Felony. The arrests were made by Flippin Police Department with Marion County Sheriff Department, and Arkansas State Police assisting.
